ONLINE BIDDING will be conducted at www.HouseAuctionCompany.com. A credit card, either Visa or MasterCard is required to register and bid. Nothing will be charged to your credit card until a purchase is made UNLESS you default in making payment as required.<br>

1. * OnLine Bidding ENDS – Wednesday, May 7th, 2014 beginning at 6:00 PM Eastern Daylight Time (subject to the “Auto Extended Bidding Feature” due to bidding activity at the closing of Auction). Please take the time to read and review the following Auction Terms &amp; Conditions. When you register to bid you will have to acknowledge that you have read and expressly agree to abide by the Auction Terms &amp; Conditions. If you have not read and reviewed the Terms &amp; Conditions then Do Not Bid. <br>

2. Auction End Times: All House Auction Company Online Auctions are timed events with a scheduled closing time, which is subject to extended bidding due to bidding activity at the closing of the Auction. NOTE: House Auction Company Online Auctions have an “Auto Extended Bidding Feature” which will become active in the last 5 minutes of the scheduled bidding period. Any bid placed on an item (“Lot”) within the last 5 minutes of the auction ending time for that Lot will automatically extend the bidding on that Lot for 5 minutes. <br>

Example: If the bidding for a Lot is scheduled to end at 6:00 pm, and that Lot receives a bid at 5:58 pm, then the bidding period for that Lot will automatically extend to 6:05 pm. Once this begins, anytime a bid is placed on any Lot in this auction with under 5 minutes remaining, an additional 5 minutes is added to the bidding period for that Lot. House Auction Company reserves the right to adjust the auto extension time period.<br>

3. STAGGERED / DYNAMIC AUCTION CLOSING: The auction will begin closing at 6:00 pm EDT at a Staggered Rate as follows: The first 32 Lots will begin closing at 6:00 pm EDT. Beginning with Lot 133, the Lots will close the rate of 50 Lots every TEN minutes, ALL subject to the “Auto Extended Bidding Feature”<br>

4. Buyer’s Premium: A 14% Buyer’s Premium will be added to the bid price on all items, with a 4% discount for payment by Cash or Approved Check with I.D. (i.e. only 10% Buyer’s Premium for payments by cash or approved check). Payment is due in full at the conclusion of auction in the form of cash, cashier’s check, personal or company check with proper ID, MasterCard, or Visa. Payment may be made on the one scheduled pick-up day – Please email if you will be picking up. The ONLY credit cards we accept are Visa and MasterCard. No credit card charge backs will be allowed. <br>

5. Catalog: House Auction Company, Inc. has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. However, all items are sold AS IS, WHERE IS with all faults, imperfections, and errors of description. Descriptions of items are believed to be correct and are provided in good faith, but are matters of opinion and not guaranteed. All purchases are considered verified by the purchaser as to grade, authenticity, quality and condition. The purchaser will rely SOLELY on his/her own judgment in any purchase. House Auction Company Inc. makes no representations or warranties, expressed or implied, concerning the items being sold. All Sales Are Final. No refunds or exchanges. <br>

6. All information contained herein is deemed to be from reliable sources. However, neither the Auctioneer nor the Seller guarantees this information to be correct. It is the bidder’s responsibility to conduct any inspections prior to the auction to determine the condition of any item and the feasibility of the bidder’s intended use. By bidding, you, the Bidder/Buyer certify that you have closely examined the item(s), have arranged for an independent agent to examine the item(s) for you, or waived your right to inspect the items. The Auctioneer represents the Seller in this transaction. All announcements made by the Auctioneer during the auction shall take precedence over all other information. SHIPPING IS AVAILABLE: If a Buyer cannot arrange pick-up on the above date and times, SHIPPING IS AVAILABLE AND IS THE RESPONSIBILITY OF THE BUYER. If a Buyer desires their item(s) shipped, upon Buyers email request, we will deliver their purchased items to The UPS Store at 4915 Arendell Street, Morehead City, NC 28557 and Buyer must then contact The UPS Store to arrange and pay for shipping. 7. Bidder Verification: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, House Auction Company, Inc. will reject the registration and bidding activity will be terminated for an unverified bidder. Bidder responsibilities include, but are not limited to: Bidders agree to keep their user name and password strictly confidential, as they are responsible for ANY and ALL activity involving their account. <br>

8. Check Payments: Out of State checks are welcomed with a bank letter of guarantee unless PRIOR arrangements have been made with Auctioneer PRIOR to the Auction and confirmed by email. Checks may be processed the day of the auction; be sure to have adequate funds in your account. Each transaction necessary to collect insufficient funds will have a $50 fee imposed. Shipment of purchases may be held until checks have cleared our escrow account. <br>

9. Outbid Notification: Until the auction begins to close, the bidding software will notify bidders by email when they have been outbid. Bidders may also find out if they have been outbid by refreshing the individual parcel / tract information. Due to varying internet connections and speed, sometimes email notifications can be delayed. Registered bidders expressly understand and agree that House Auction Company, MarkNet Alliance and the Seller are not responsible or liable for the failure of any part of the bidding process or internet bidding.<br>

10. Property Information &amp; Inspection: By registering and bidding in this auction, Bidder expressly acknowledges that they have personally inspected the property, or have arranged for their agent to conduct an inspection of the property, or have waived their right to inspect the property they are bidding on, and further agree to abide by the Terms and Conditions as set forth herein. House Auction Company, Inc. (“Auctioneer”) is not responsible for any missing or incorrect information. Descriptions provided by Auctioneer are provided in good faith and are matters of opinion. It is the bidder’s sole responsibility to conduct any inspections to determine the condition of the property and feasibility of bidder’s intended use. By placing a bid, this creates a contractual agreement by the bidder to purchase the property at the high bid price plus Buyers Premium and any additional fees included in the closing of the real property transaction. <br>

12. Auctioneer’s Discretion: House Auction Company, Inc. has full discretion to modify the date and time, order and details of the auction for any reason, including but not limited to technical issues, emergencies, and convenience of House Auction Company, Inc. or the Seller. We gather aggregate information from the website, which may include but is not limited to: number of page visitors, most visited pages, and any and all correspondence. House Auction Company, Inc. has the sole authority to resolve any bidding disputes as they may arise.<br>

13. Server &amp; Software Technical Issues: In the event there are technical issues related to the server, software or any other online auction related technologies, House Auction Company, Inc., MarkNet Alliance and the Seller reserves the right to extend bidding, continue the bidding, or close the bidding. By registering and bidding in this auction each bidder automatically and expressly acknowledges that House Auction Company, Inc., the Seller, MarkNet Alliance, and the company providing the software shall NOT be responsible or liable for a missed bid or the failure of the software to function properly for any reason. Email notifications may be sent to registered bidders with updated information as deemed necessary by House Auction Company, Inc. <br>

14. Default of Bidder and/or Buyer: The Successful Bidder and/or Buyer not attempting to settle their invoice on or before the scheduled Pick-up Date will be considered in default and will be black-flagged in our database as a Non Paying Bidder. House Auction Company, Inc. reserves the right to sell to the next highest qualified Bidder and or Buyer in the event the successful high Bidder or Buyer does not comply with the terms of the auction. By bidding on any item in the auction, the Buyer agrees to abide by all terms and conditions as set forth. By registering and placing a bid, the bidder hereby agrees that should they become a Default Bidder or Non Paying Bidder, House Auction Company, Inc. has the right to charge their credit card for the entire balance of their invoice. If House Auction Company, Inc., is able to sell the defaulted item(s) to the next highest qualified Bidder at a price lower than the auction high bid price, then the defaulted Bidder expressly agrees to allow House Auction Company, Inc., to charge their credit card for the difference in their bid price and the actual selling price to the Backup bidder.<br>
